‍Application means the software program provided by the Company downloaded by You on any electronic device, named SHARPZ.

‍Betting Information means any betting data from any sportsbook that you link to the SHARPZ platform directly or through third party providers, which includes, but is not limited to type of wager(s), monetary amounts wagered, details of wager(s) such as sport(s), league(s), player(s), competition(s), team(s), and odds, profits and losses from wager(s), number of wager(s), result(s) of wager(s), the statistics an analytics of bets as it relates to tracking and recording betting performance, and the name of any linked sportsbook and the State and/or Province such sportsbook is located.

‍Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers' personal information and determines the purposes and means of the processing of Consumers' personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers' personal information, that does business in the State of California.

‍Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Sharpz LLC, 2125 Eighth St, #320. For the purpose of the GDPR, the Company is the Data Controller.

‍Consumer, for the purpose of the CCPA (California Consumer Privacy Act), means a natural person who is a California resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.

‍Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

‍Country refers to: Michigan, United States.

‍Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

‍Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

‍Sale, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer's personal information to another business or a third party for monetary or other valuable consideration.

‍Service refers to the Application or the Website or both.

‍Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.

‍Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

‍Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

‍Website refers to Sharpz, accessible from sharpz.  app and/or other web addresses as well as the Sharpz mobile application accessible through the App Store.

‍You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. Under GDPR (General Data Protection Regulation), You can be referred to as the Data Subject or as the User as you are the individual using the Service. Collecting and Using Your Personal Data.

Personal Data
‍While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to your: Email address Telephone number First name and last name Usage Data Any information Sharpz collects from you online and/or through Sharpz mobile application and maintains in association with your account including: your username, your password, your unique promotional code for inviting others to join the Sharpz App, and your Instagram and/or Twitter username(s) that you may elect to display in your Sharpz profile. Sharpz may also collect personal information from individuals (with their consent) at in-person events such as sporting events, tailgates, and conventions.

‍Usage Data
‍Usage Data is collected automatically when using the Service. Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data. When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data. We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.

‍Information from Third-Party Social Media Services
‍The Company may allow You to create an account and log in to use the Service through the following Third-party Social Media Services: GoogleFacebook (Meta) Twitter Instagram If You decide to register through or otherwise grant us access to a Third-Party Social Media Service, We may collect Personal data that is already associated with Your Third-Party Social Media Service's account, such as Your name, Your email address, Your activities or Your contact list associated with that account. You may also have the option of sharing additional information with the Company through Your Third-Party Social Media Service's account. ‍We also use third-party service providers to facilitate in providing You with the best experience possible on Sharpz. We are not responsible for privacy practices of others including those that may provide technology services to us and we strongly encourage you to review any third party’s own Privacy Policy. Generally, these third-party technology providers will only collect, use, and disclose your information as necessary to allow them to perform services for us. We also allow you to connect your sportsbook account(s) to Sharpz. If You choose to connect a sportsbook account to Sharpz, directly or through a third-party service provider, we may have access to your betting information. If you choose to create an account connection, we may receive your betting information even while you are not using Sharpz. For example, if you connect your Sharpz account to a sportsbook account, we will receive betting information via the account connection. We will use all such information that we receive from a third-party via an account connection in a manner consistent with this privacy policy and before authorizing an account connection, you should review the privacy notice of any third-party that will gain access to your personal information as part of the account connection. If you decide to connect a sportsbook account to Sharpz by any means, you agree and authorize us to collect your betting information.

‍While using Our Application, in order to provide features of Our Application, We may collect from You: Pictures and other information from your Device's camera and photo library Social Posts including content connected to the post(s) that may include video(s), photograph(s), image(s), commentary, and betting information Betting information We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device. You can enable or disable access to this information at any time, through Your Device settings.
